1. The Liability Gap: When an AI medical system misdiagnoses a patient, or an autonomous vehicle kills a pedestrian, existing liability frameworks struggle. Product liability requires a "product" with a manufacturer; negligence requires a duty and identifiable breach; contract requires privity. AI systems are none of these cleanly. The EU AI Act (2024) begins to fill this gap by classifying AI systems by risk and imposing corresponding obligations — but attribution of responsibility in multi-actor AI chains remains unsolved.

2. Jurisdiction's Collapse: Data flows across borders in milliseconds. A company incorporated in Delaware, with servers in Ireland, processing data from Chinese users via software written in India, regulated by EU GDPR — which law applies? The answer is "all of them, simultaneously, sometimes contradictorily." The governance of cyberspace remains the most unresolved jurisdictional problem in legal history.

3. The Personhood Question: Should AI systems have legal personhood — enabling them to own assets, enter contracts, bear liability? The EU considered "electronic personhood" for robots in 2017 and rejected it. But as AI systems become more autonomous and consequential, this question becomes less hypothetical. The alternative — treating AI as property, with all liability falling on owners — may become increasingly inadequate.
